It's not, it's a 100% backtrack, flip-flop, whatever you want to call it. It belongs firmly in the "disappointments" thread as yet another thing Obama promised and failed to deliver on. By taking an active role in perpetuating America's drug war, Obama shares the blood, now on his hands, with prior administrations. American drug policies are strongly to blame for thousands of deaths, many of them civilians, in Mexico. The drug cartels in Mexico are only able to operate as they are because they have no competition from legal sources in the US. Face it liberals, Obama is not the guy you wanted. You all got duped. He's yet another corporatist who bows easily to demands from lobbyists and other influences.

not wrong thread per se, but i'm getting ahead of myself and anticipating that the next place we'll see this case is in the Supreme Court, which has two Obama appointees. a positive ruling will vindicate Obozo in a huge way; after all, he did appoint two flaming reds to the court (and possibly has the chance to appoint one or two more next term).
I suppose so. There's no way the Supreme Court can rule Prop. 8 legal. It's not about homosexuality; they would be forced to look at it as an issue of whether or not the voting majority can decide if minorities have rights, and obviously they can't. So if it goes to the SC it's sort of a foregone conclusion.
From what I've read, the court said the Prop 8ers have no standing or overriding interest in keeping teh gays single. Since the ppl behind Prop 8 have nothing to do with actually wanting to ban gay marriage but instead are just using a political prop to get an unpopular minority in the news and bring Republicans out to the polls (see: Arizona SB 1070), I think it is fairly safe to assume the Prop 8 ppl will appeal this decision instead of escalate it to SCOTUS, where Prop 8 would be surely struck down. Going the former route will keep the base fired up and angry at liberals. Or do the Prop 8 people have a choice? Like, will SCOTUS take it up regardless?
How do you appeal to the same court? I thought it would have to go higher if there were any appeal at all? It's not like 9th district will be like, oh yeah, we change our minds now.

The 9th circuit has 29 active justices. When a case comes to them, 3 are selected at random who will hear the case. The losing party can ask the court to reconsider the cause en banc, which would normally mean the entire court, and the entire court will normally tell them to fuck off. In the case of the 9th circuit, en banc hearings are scaled down to a different, randomly selected group of 11 justices. The 9th circuit is notoriously the most liberal in America, so there's no real likelihood that they'd review a decision that favors liberal interests. This will get filed with the SCOTUS, and my guess is that they'll deny it cert. This particular liberal judge pulled a pretty shrewd move in crafting this decision to be very unappetizing to the folks in DC. I suspect that when they announce their next caseload, this one won't be in it, and the anti-homo crowd will have to start again from scratch.

When I lived in India my workplace was surrounded by a barbed wire fence and had a guy with a shotgun guarding it. I felt safer, considering there were all manner of people and animals outside my workplace who might try to get in and ask me for some of the chicken curry I was having for lunch at the on-site restaurant. I feel the same way about snipers at the Super Bowl.
